For one, Dalton McGinty can't just tell the SIU not to investigate something. The SIU investigates whenever there is death or serious injury during a police action. And, rest assured as always, no matter what the police did or didn't do, they'll rubber stamp their approval, whether the police acted wrongly or not. Well, you completely overreacted to the story I posted, perhaps it's my fault for not explaining myself more. I don't blame McGuinty any more than any other politician really, i was commenting more about the criminal in the story with dozens of convictions still on the street. We can't rehabilitate everyone. Perhaps that column was not the right example but I had read it somewhere recently so it came to mind.

There was a case from a 2 or 3 years ago where 3 men picked up an eleven year old girl and raped her.
The Canadian judge concluded that it was likely the little girl's fault because she was molested as a child so was probably promiscuous and seduced the men. So they got no time in jail.
I wonder if that's the type of discretion he meant.
By the way I'm not making up that story about the 3 men. It did make National News. I will dig deep and find it. It may take a while.

I just dislike draconian minimum sentences. They never seem to work and often lead to the law going around them to avoid it. Like finding them guilty of a lesser offense to avoid using them.
I prefer a wide range of sentencing available without strict minimums or maximums.

In criminal law "the victim" is the state. That's why we have a criminal justice system (as flawed as it may be) rather than allowing for vigilanteeism and vendettas.
I prefer a wide range of sentencing available without strict minimums or maximums.
We do have maximums, though. And while I've heard lots of people argue against mandatory minimums, on the grounds that judges should have discretion, I've yet to hear any of them argue against mandatory maximums. Which is laughably inconsistent. If you trust judges, then trust them. If you don't, let's talk mandatories.
And right now Snert its incredibly hard to get a 'dangerous offender' designation on someone to keep them in jail, so yeah I really would prefer two things
1-guidelines but no minimums or maximums so dangerous or unfixable repeat offenders can stay in jail
2-education for judges on the mind of offenders, rehabilitation and the success or failure according to the crime. And more education on the long term effects of victims from the crime
I was demonstrating the contrast between current "punishment" which is a maximum of two years (of being confined to a Protective Custody facility were they get their own room with satellite TV, DVD player, video games, etc) to something extreme and unrealistic.
Of course I wasn't serious. If lengthening a sentence by 12 months is barely accomplished how would something as extreme as lobotomization ever be considered. As for being over a line, some people consider saying anything other than, "let's just build rehabilitation centers for them and when they are released and rape another infant we'll pat them on the back and say at least you tried," - being over their line.
Posting an article from the Calgary Sun about a Judge standing behind a decision to give a pedophile one extra year was over a line for some - so they flagged it and successfully had it deleted.
Though I am not seriously suggesting that Canada start lobotomizing pedophiles, a lobotomy is a far cry less extreme than Capital Punishment. I knew before I posted it that those from the pro-pedophilia movement would frantically flag that post.
Capital Punishment is still legal even in the US. But it is far more extreme than any other punishment even lobotomy.

Let me share some stuff, and maybe I'm waving creds around a bit, but so be it. I was a victim of a pedophile from about age 5 (that memory is a bit foggy) to early teens. I was raped, and exposed to a lot of pretty ugly and weird stuff by way of 'grooming' me. By 13 - 14 I thought I had become strong and been assertive and made him stop. I found out later I had just aged to the point he was no longer interested in me. Since then I've worked in group homes, and later other areas in the children's mental health field, and had close contact with the damage caused by pedophiles.
So my friend, I know a bit about whereof I speak.
Therefore let's get one thing straight from the start. NO ONE GOT YOUR POST DELETED! It just went along with some others for reasons I've already made clear.
Secondly, people who want to give due thought to what will work best in both the deterrance of pedophilia, as well as the treatment of pedophilia, and wish to do so within an effective, humane and progressive framework are not "pro-pedophilia' . Well, in response to suggestions of castration or lobotimization, I think it actually warrants some discussion.
Now, if a person is a pedophile in the sense that they have sexual desires towards children, and if they have shown that they are not able to control those behaviours, thus putting children at risk - it is therefore society's obligation to ensure that the pedophile does not harm more children.
There are various ways to go about this:
1) Lifetime sentences. 2) Sex offender registries and police monitoring, limited access to daily life. 3) Physical changes
I think that for many, the choice between lack of freedom, and surgical changes, many would opt for the surgical change. While, we don't want to blemish our hands with surgincal changes, the fact remains that it may be the most humane solution for all involved. Of course, such a procedure would have to be voluntary.

Thinking about this, it strikes me that we are going to remember, and the media is going to report only the worst cases. They won't report, and we won't take note of cases where people have been rehabilitated, and never go on to drive drunk again, or return to attacking children.

I've been active in politics enough to know that many judges are judges not on knowledge of law, but on knowledge of political fundraising.
Which isn't a segue into the idea of electing judges or Crown Attourney's. We see that system in the States, and we also see abhorent sentences and misscarriages of justice there.
I think it's all about consequences. There's no consequences for idiot judges. And there's no consequences for Crown Attourney's that screw with the law. And, I think we'd see a bit less of these tragic cases like offenders given too many chances after demonstrating that they shouldn't and maybe a bit less of the tragic cases where people are wrongfully convicted if there were consequences for the administrators of justice when things go awry, beyond the scope of normal human error.
In short, it would make the administration of justice a little less capricious than it is now, and we'd all be a little safer.

I believe in strong sentencing for child sex offenders but I do think it is possible to go too far.

For one, Dalton McGinty can't just tell the SIU not to investigate something. The SIU investigates whenever there is death or serious injury during a police action. And, rest assured as always, no matter what the police did or didn't do, they'll rubber stamp their approval, whether the police acted wrongly or not. Idjit boy who writes for the Sun tabloid either chose to ignore that, or doesn't know.
I believe Dalton McGinty has a lot to answer to, but trying to link him and a skating trip to those deaths is the kind of pap the Sun tabloid likes to engage in. It really doesn't further anything.
Perhaps if Warmington could write, and had half a brain, he'd have observed that the whole justice system in Ontario is in dissaray. The SIU is being investigated again by the Ombudsman. The head of the OPP is before the courts. Crown Attourney's ignore the directives of the Attourney General. A pathologist makes stuff up and ruins lives, yet there are no consequences, as there are no consequences for Crowns who withhold exculpatory evidence.
It's nice to believe, if it gives you comfort, that there's some kind of partizan political bias in our judicial system and law enforcement, or some kind of left wing/right wing conspiracy-- according to one's own bias-- in the system. But it's not that.
It's an institution that has come to exist for it's own benifit, to protect and promote first and foremost and it seems exclusively, the interests of the institution.

Well, you completely overreacted to the story I posted, perhaps it's my fault for not explaining myself more. I don't blame McGuinty any more than any other politician really, i was commenting more about the criminal in the story with dozens of convictions still on the street. We can't rehabilitate everyone. Perhaps that column was not the right example but I had read it somewhere recently so it came to mind.

Yeah, I'm having trouble comprehending that too.
There was a case from a 2 or 3 years ago where 3 men picked up an eleven year old girl and raped her.
The Canadian judge concluded that it was likely the little girl's fault because she was molested as a child so was probably promiscuous and seduced the men. So they got no time in jail.
I wonder if that's the type of discretion he meant.
By the way I'm not making up that story about the 3 men. It did make National News. I will dig deep and find it. It may take a while.

I just dislike draconian minimum sentences. They never seem to work and often lead to the law going around them to avoid it. Like finding them guilty of a lesser offense to avoid using them.
I prefer a wide range of sentencing available without strict minimums or maximums.

In criminal law "the victim" is the state. That's why we have a criminal justice system (as flawed as it may be) rather than allowing for vigilanteeism and vendettas.
We do have maximums, though. And while I've heard lots of people argue against mandatory minimums, on the grounds that judges should have discretion, I've yet to hear any of them argue against mandatory maximums. Which is laughably inconsistent. If you trust judges, then trust them. If you don't, let's talk mandatories.
And right now Snert its incredibly hard to get a 'dangerous offender' designation on someone to keep them in jail, so yeah I really would prefer two things
1-guidelines but no minimums or maximums so dangerous or unfixable repeat offenders can stay in jail
2-education for judges on the mind of offenders, rehabilitation and the success or failure according to the crime. And more education on the long term effects of victims from the crime

I was demonstrating the contrast between current "punishment" which is a maximum of two years (of being confined to a Protective Custody facility were they get their own room with satellite TV, DVD player, video games, etc) to something extreme and unrealistic.
Of course I wasn't serious. If lengthening a sentence by 12 months is barely accomplished how would something as extreme as lobotomization ever be considered. As for being over a line, some people consider saying anything other than, "let's just build rehabilitation centers for them and when they are released and rape another infant we'll pat them on the back and say at least you tried," - being over their line.
Posting an article from the Calgary Sun about a Judge standing behind a decision to give a pedophile one extra year was over a line for some - so they flagged it and successfully had it deleted.
Though I am not seriously suggesting that Canada start lobotomizing pedophiles, a lobotomy is a far cry less extreme than Capital Punishment. I knew before I posted it that those from the pro-pedophilia movement would frantically flag that post.
Capital Punishment is still legal even in the US. But it is far more extreme than any other punishment even lobotomy.
But I know that the mere 3 word sentence will give some people the excuse they have been looking for to claim that I should be banned.

Let me share some stuff, and maybe I'm waving creds around a bit, but so be it. I was a victim of a pedophile from about age 5 (that memory is a bit foggy) to early teens. I was raped, and exposed to a lot of pretty ugly and weird stuff by way of 'grooming' me. By 13 - 14 I thought I had become strong and been assertive and made him stop. I found out later I had just aged to the point he was no longer interested in me. Since then I've worked in group homes, and later other areas in the children's mental health field, and had close contact with the damage caused by pedophiles.
So my friend, I know a bit about whereof I speak.
Therefore let's get one thing straight from the start. NO ONE GOT YOUR POST DELETED! It just went along with some others for reasons I've already made clear.
Secondly, people who want to give due thought to what will work best in both the deterrance of pedophilia, as well as the treatment of pedophilia, and wish to do so within an effective, humane and progressive framework are not "pro-pedophilia' . To characterize them as such is beyond offensive and will not be tolerated. Not everyone shares your experience or shares my experience. Everyone who has posted here wants the best outcome and is an ally. We don't alienate allies.
Lonewolfbunn you point out flaws in the system, and how the legal system fails in protecting society's most vulnerable members. You're right. A lot of people here will be supportive, and I can tell you as a 9 year member of babble that a lot more people than you'd think have lived experience.

Well, in response to suggestions of castration or lobotimization, I think it actually warrants some discussion.
Now, if a person is a pedophile in the sense that they have sexual desires towards children, and if they have shown that they are not able to control those behaviours, thus putting children at risk - it is therefore society's obligation to ensure that the pedophile does not harm more children.
There are various ways to go about this:
1) Lifetime sentences.
2) Sex offender registries and police monitoring, limited access to daily life.
3) Physical changes
I think that for many, the choice between lack of freedom, and surgical changes, many would opt for the surgical change.
While, we don't want to blemish our hands with surgincal changes, the fact remains that it may be the most humane solution for all involved. Of course, such a procedure would have to be voluntary.
First, I lost track of this thread, so sorry to Yarg for not responding, and thanks Bacchus for the update on Fantino. I thought you had offered up the whole article Yarg, as something wholly salient, hence my reaction.
I'm not sure that physical removal of the testes or even penis would be a silver bullet solution, voluntary or otherwise.
While it's understandable that we all want a 100% garantee that would protect children, it's not going to happen. But, that's not to say we shouldn't do our best.
I wonder, Keystone, if we should offer career and pathological theives the option of hand amputation to long sentences?
Thinking about this, it strikes me that we are going to remember, and the media is going to report only the worst cases. They won't report, and we won't take note of cases where people have been rehabilitated, and never go on to drive drunk again, or return to attacking children.
So, I'm not sure we should be all set to recalibrate our laws to suit the abhorent cases alone.
Like Bacchus above, I like the idea of judges having discretion in sentenceing. I wonder though, how wide it should be. I remember the case lonewolfbunn cited above. That was inexplicable. Unforgivable. And, I wonder how judges like that got to where they are. Well, I don't wonder. I've been active in politics enough to know that many judges are judges not on knowledge of law, but on knowledge of political fundraising.
Which isn't a segue into the idea of electing judges or Crown Attourney's. We see that system in the States, and we also see abhorent sentences and misscarriages of justice there.
I think it's all about consequences. There's no consequences for idiot judges. And there's no consequences for Crown Attourney's that screw with the law. And, I think we'd see a bit less of these tragic cases like offenders given too many chances after demonstrating that they shouldn't and maybe a bit less of the tragic cases where people are wrongfully convicted if there were consequences for the administrators of justice when things go awry, beyond the scope of normal human error.
In short, it would make the administration of justice a little less capricious than it is now, and we'd all be a little safer.
