Ex-prosecutor wanted to charge Bill Cosby but lacked evidence

Bruce Castor also told CNN that he believed Cosby -- a beloved figure who, with his wit and boyish smile, has charmed audiences as a family-friendly stand-up comic, the voice of Fat Albert, the host of "Picture Pages" and the star of a wildly popular eponymous sitcom -- lied to authorities.

In January 2004, Andrea Constand, then a 31-year-old staffer for the women's basketball team at Temple University, Cosby's alma mater, was at the comedian's Cheltenham, Pennsylvania, home when Cosby provided her medication that made her dizzy, she alleged the following year.

She later woke up to find her bra undone and her clothes in disarray, she further alleged to police in her home province of Ontario in January 2005.

Cosby's attorney in the case, Walter M. Phillips Jr., called the allegations "utterly preposterous" and "plainly bizarre" at the time, yet in a civil filing, Constand's lawyers said they had found 13 "Jane Does" with similar stories. Cosby settled the civil suit in 2006.

The terms of the settlement were not disclosed, but when journalist and publicist Joan Tarshis came forward with another similar story this weekend, Cosby attorney John Schmitt denied her claim and others', labeling them "decade-old, discredited allegations." Schmitt later amended that statement to say he wasn't referring to Constand, who resolved her differences "to the mutual satisfaction of Mr. Cosby and Ms. Constand years ago."

'I couldn't check her blood'

Castor, who was the district attorney for Montgomery County, Pennsylvania, when Constand came forward in 2005, now tells CNN he thought Constand was credible, and he thought Cosby was evasive in his interview with prosecutors. Castor, whose assistants interviewed Cosby, said he felt the comedian was setting up a defense that Constand was at his house on her own volition and that anything occurring between them was consensual.

"Back then, the desire on our part to move forward was pretty strong," he said. "The problem with the case was she waited a year until she told police about it."

This left Castor no way to corroborate Constand's allegations, he said. He couldn't check her blood, urine, hair or fingernails for traces of drugs, he couldn't obtain hair or fiber for analysis, and he couldn't obtain a warrant to search Cosby's home for evidence.

NBC drops new Bill Cosby sitcom as Netflix postpones comedy special, TV Land pulls reruns amid sexual assault allegations

The planned NBC show was due to launch in 2015 and was supposed to mark the comedian’s return to the network. TV Land has also pulled 'Cosby Show' reruns from its schedule. Three women, including former supermodel Janice Dickinson, claimed the entertainer drugged and raped them between 1969 and 1985. A fourth woman posted on Facebook that she too was assaulted, but deleted the accusation hours later.

BTW, as we all know, if the allegations against Cosby are lies, he could sue them.  Will that happen?  Probably not since:

Bill Cosby testified in 2005 that he got Quaaludes with the intent of giving them to young women he wanted to have sex with, and he admitted giving the sedative to at least one woman and "other people," according to documents obtained Monday by The Associated Press.

The AP had gone to court to compel the release of the documents; Cosby's lawyers had objected on the grounds that it would embarrass their client.

The 77-year-old comedian was testifying under oath in a lawsuit filed by a former Temple University employee. He testified he gave her three half-pills of Benadryl.

 I read on a voice for men that some people used to take Qaluudes to enhance they're orgasm, I wonder if Bill Cosby took any himself. I don't know if Bill sexually assaulted anyone, or not, although its not looking good for him, but at this point its a safe bet he's a stoner, which makes his antidrugs messaging hypocritical.

 I don't know why people rely on booze and party drugs to enhance sex, the brain is the only dealer you need, aside from medical issues.

There is a difference between using booze, illegal or prescription drugs to secure or bypass consent and enjoying a couple of glasses of wine or a joint with a person you are interested in.

And my brain doesn't really get into gear before the first shot of espresso, early in the morning.

In any case,the man is guilty but thanks to the statute of limitations he'll walk away. What will be left of his career and reputation is another story.

It depends.  Fried egg doesn't sound all that appealing if we're talking about meringue.

Both are shot through I would think.  We would also have to assume that perhaps some of his co-stars from the Cosby Show who were previously receiving royalties from now cancelled syndication deals are consulting their own lawyers.

I'll tell you by experience.Alcohol dulls,delays and/or prevents orgasm or even erection for males.There are quite a few drugs,including quaaludes,that really do enhance sex.

Not completely clear.  At least one of the women is arguing that the statute should start running from the date that she realized that her problems resulted from his actions.

More recently, there were a series of court documents that were unsealed and revealed a dark side to the Cos.  Rather than spending his time bouncing kids on his knee and eating Jell-O brand pudding, this Bill was involved in illegal drugs and illicit sex, fornication, and perhaps more.

I’ve done a lot of thinking over these weeks.  The good Bill has done over the years is real and enduring.  I am not prepared to simply dismiss his brilliance, his wisdom, or his legacy.  You see, all of that is a part of who I am as a man – as a Black man.  I am not going to toss all of that away, at least not yet. It seems to me that one should be able to look with sober eyes and yet hold on to those elements of substance that are both true and comforting.

That is the truth that people refuse to believe and that makes it so difficult to believe women who have been abused. Great guys that everyone loves sexually abuse women and children. Most of them aren't monsters. They walk amongst us, sit in our classrooms, work with us, treat us for illnesses, marry us. The only way to be sure you won't be raped is to never be alone with a man. The only way to avoid coming into contact with rapists is to stay away from men, practically impossible to do if you leave your home. I don't definitely come into contact with bank robbers when I take public transportation. I definitely come into contact with rapists every time I take public transit or go to a grocery store.

Mary Koss’ much-discussed 1987 study of rape prevalence is famous mostly for its fidning that 1 in 8 college women have been victims of rape at some point in their lives. What’s not as well known is that the same study also surveyed thousands of college men, asking them about if they had ever forced a woman to have sex against her will. About 4.5% reported that they had.

If you take every doctor and nurse in the United States; and you added them to every librarian, every cashier, every cop, every postal clerk, and every bank teller in the whole country; you still wouldn’t have as many people as the number of rapists in the United States.

It seems to me that they way this question is phrased, it doesn’t exclude coercive intercourse with a girlfriend (or spouse!).

It would seem to me that to get a meaningful ratio of rape victims, one would need to put “holding down your reluctant girlfriend” into a different category than “rape of/by someone that you don’t have an ongoing sexual relationship with”.

Many rapists don't even think they are rapists. A more recent study cites 6% of men.

 A study published in 2002 by David Lisak and Paul Miller, for which they interviewed college men about their sexual histories, found that only about 6 percent of the men surveyed had attempted or successfully raped someone. While some of them only tried once, most of the rapists were repeat offenders, with each committing an average of 5.8 rapes apiece.

Campus sexual assault has received less attention from researchers outside the U.S.. Studies that have examined sexual assault experiences among college students in western countries other than the U.S. have found results similar to those found by American researchers. A 1993 study of a nationally representative sample of Canadian College students found that 28% of women had experienced some form of sexual assault in the preceding year, and 45% of women had experienced some form of sexual assault since entering college.[16] A 1991 study of 347 undergraduates in New Zealand found that 25.3% had experienced rape or attempted rape, and 51.6% had experienced some form of sexual victimization.[17] A 2014 study of students in Great Britain found that 25% of women had experienced some type of sexual assault while attending university and 7% of women had experienced rape or attempted rape as college students.[18]
