Why allegations of obstruction of justice likely won't be enough to unseat the president

No president has ever been impeached by his own party, notes Josh Huder, a senior fellow with the Government Affairs Institute at Georgetown University. "So this would be truly uncharted territory."

With Republicans controlling both chambers, Huder says Trump would have to lose major support from his base in order for congressional Republicans to start worrying about their own seats.

"If Republicans in Congress start to feel that [this] jeopardizes their re-election, or the GOP brand, or the majorities in the House and the Senate," says Huder, then Trump's support in the party would "evaporate," triggering "a more precipitous" dive toward impeachment.

Party support that dips into the 70 per cent range is "where landslide elections start to occur," Huder says. "If you're getting below 80 per cent of your own [party's] support, you're looking at a very bad election."

'When the people demand it'

Impeachment — which is like an indictment — would be the first step toward being booted from office. 

Initiating impeachment proceedings is reserved for the gravest abuses of power, including treason, bribery and the more open-to-interpretation offence of "high crimes and misdemeanours."

It was under the "high crimes" justification that Bill Clinton was impeached, on the grounds of obstruction of justice, in 1998 in connection with a consensual affair. 

Nixon also faced obstruction of justice charges, though he resigned before an impeachment vote. A president can be prosecuted in a criminal trial after leaving office, but likely not while sitting in office.

Impeachment is not synonymous with removal from office, but removal can't happen without impeachment.

Multiple sources close to the intelligence, justice and law enforcement communities say that the House Judiciary Committee is considering Articles of Impeachment against the President of the United States.

Sources further say that the Supreme Court notified Mr. Trump that the formal process of a case of impeachment against him was begun, before he departed the country on Air Force One. The notification was given, as part of the formal process of the matter, in order that Mr. Trump knew he was not able to use his powers of pardon against other suspects in Trump-Russia cases. Sources have confirmed that the Marshal of the Supreme Court spoke to Mr. Trump.

It was reported this week that Mr. Trump had texted Lt. Gen. Mike Flynn the message ‘Stay strong’. This might be interpreted as an attempt to intimidate a witness, sources say.

Deputy Attorney General Rosenstein met with the House Judiciary Committee this week in closed session.

Sources close to the intelligence community report that Director Comey’s FBI computer was illegally accessed immediately after he was dismissed from his post. They further report that ‘removable media’ was used in the commission of this crime. ‘Removable media’ is a category describing physical devices that can be placed into a computer, either to download information or to upload it, such as a memory card, a USB stick, a removable hard drive, a thumb drive or similar items.

Sources further report that a person or persons allied to Donald Trump passed data accessed from Director Comey’s computer to Russian diplomats. It is not known when or how this took place. A piece of removable media containing all the data in question has been recovered from hostile actors, sources say, and is now in the possession of the Justice Department.

Director Comey is said to have known in advance that Mr. Trump would dismiss him. He took careful steps, these sources say, to leave not only a paper trail as we have seen in the story of the ‘Comey Memo’ but also a digital one. Director Comey’s own primary work computer, and other computers in and around his former office, were fitted with sophisticated intelligence community software allowing the Justice Department to see precisely how and when they were attacked.

Sources say that the extensive plan, multiple pages in length, covered not only the serving of warrants, but logistical arrangements such as the closure of streets, if necessary.

I'm not telling you that you need to wait until The Washington Post, the New York Times or CNN reports that an impeachment is underway.  Pick whoever you want.

I'm just suggesting that if ANY news organization tells us that the impeachment has begun when it hasn't, that could be a news organization to abandon.

I wonder if Black Agenda Report is in favour of the federal hate-crime laws. Because those entail the FBI conducting an investigation into the crimes in question.

Not that I think what Trump did was the moral equivalent of a hate-crime, just that if our criteria is going to be "We should oppose any investigation conducted by the FBI", the implications are going to be rather interesting.

I was confused by that as well.  To the point of reading the house rules.  The closest I could find was that an impeachment motion (impeachment being similiar to indictment) could be forwarded to Congress for consideration from a Grand Jury.  However when I went to the Patribotics article, it didn't say what is being represented.  It spoke about the Supreme Court sending an emisary to remind Trump about the importance of submitting evidence requested regarding his Muslim ban executive order.  The only mention of impeachment was the throwaway lines about failing to submit evidence is an impeachable offence.

I agree, and as Mike Figuredo points out, the real issue isn't Donald Trump but how people in charge get away with all kinds of things regular people don't, whether people in charge are Trump, Clinton, or anyone else.

Trump is the first rich and powerful person to hint at what they want as an outcome. They have even invented a brand new term for it, plausible deniablity.  

Even if one believes Comey the question is whether a stated "hope" is sufficient proof to meet a criminal test of obstruction. In Comey's testimony there was no threat or offer of a quid pro quo so it sounds like an uphill battle to show obstruction of justice and not merely gross impropriety which is not an impeachable offence.
