I have been following the Ceta negotiations. As you may know CUPE sent a delegation to Europe recently to learn what it could. One of the CUPE delegate sent out a daily journal to which i refer to below. My question to you Shane..Is there anything preventing any provincial government from saying no our province will not agree to CETA?

Hi Paul,

Thanks for your email. While this is not directly my file I do know a bit about the issue. You are correct, there are aspects of CETA that deal directly with provincial jurisdiction and authority. On those matters it appears the BC Liberals are concurring with Prime Minister Harper. As the New Democrat Opposition we have taken the position that this agreement is not beneficial to the interests of British Columbians and should we form government before the deals are committed to, we will not be supportive. We will also debate this issue in the Legislature should we get the opportunity.

An important but hard question to answer. While the provinces can protect some issues it may be possible for creative negotiators to get around that. Hard to say without more information. But we could make it tougher no doubt.

It doesn't matter whether it is in the provincial realm because any breach becomes the federal governments liability. Corporations have done well settling claims against the federal government for the actions of provincial governments. These investor rights agreements don't care about internal constitutions in any country because corporations are given the right to sue the signatory to the treaty in front of a arbitration panel outside of any countries court system.  As far as I can see that seems to be the main purpose of them. In Canada our federal government has been negotiating settlements.  In the future with big energy projects a province could potentially bankrupt the federal government by invoking its constitutional rights to act in relation to section 92 matters.

I don't even understand why as a country we would want to get involved with the failed European Common Market.  Its industrialized north is  already exploiting workers in the southern countries and inflicting austerity on all and sundry. These are not the types of people we should be negotiating anything with. It is not like we don't already trade with European countries. All parties bring their best corporate lawyers to negotiate the terms.  I think that is all one needs to know about the process to understand its inherent bias.

..my intitial reason for contacting my mla was to find out 1st what the ndp position was and 2nd to learn if a province can prevent the negotiations from going forward. the position you pose, i believe, is after the fact. 

..my 3rd reason is that, like the pipelines, the prov ndp is susceptible to pressure from below. the pressure would include municipalities who have come out against ceta. it would be far easier and with a greater chance of success to stop ceta now.

Indigenous resistance grows strong in Keystone XL battle

On cloudy days, heavy smoke fills the air of Ponca City, Okla., with grey smog that camouflages itself into the sky. The ConocoPhillips oil refinery that makes its home there uses overcast days as a disguise to release more toxins into the air. These toxins are brimming with benzene — a chemical that, according to the Centers for Disease Control, can cause leukemia, anemia and even decrease the size of women’s ovaries. According to the Environmental Protection Agency, in 2008 the ConocoPhillips refinery released over 2,000 pounds of this chemical into the air in Ponca City.

“Of the maybe 800 of us that live locally, we have averaged over the last five to seven years maybe one funeral a week,” explained Casey Camp-Horinek, a Ponca woman and longtime activist. “Where we used to have dances every week, now most people are in mourning.”...

Santee Sioux Tribe Rescinds Resolution to Support TransCanada, Inc. KXL Pipeline

“Wow, I wonder if we will get to see the cranes?” was the thought on my mind. I had just hung up the telephone from a conversation with a movement brother who was calling from the Santee Sioux Nation Tribal Office. He had said that TransCanada was on the Tribal Council Agenda, and that council had just passed a Tribal Resolution to Support TransCanada’s KXL Tarsands Oil Pipeline in the area of economic development and job opportunities. “What??” I practically screamed into his ear. (Sorry, bro!). So, to make a long story short, we answered the call from our good brother to come to Santee Sioux Nation.

We got some funds together, formed a delegation of activists, singers, speakers, warriors, elders, planned our route, got some gas money, made a plan and called our bro to let him know we were coming to answer the call of our allies.

Our Santee allies held community meetings, got some meals together, gathered funds, rented our delegation some cabins, made fliers, secured a training location, did radio spots to let their people know we were coming to do a Sacred Water Protection Teach In on May 7 at 1pm at the Oyate Center in Santee Village....

TransCanada Reps Kicked Out of Cheyenne River Sioux Reservation

“You’re not welcome here… We’ve said no from day one.”

And with these firm words the TransCanada representatives were kicked out of Cheyenne River Sioux Reservation last week. The seemingly aloof TransCanada officials showed up at the Tribal Office in Eagle Butte, South Dakota in an attempt to win the tribe over to the pipeline, but were met with a swift, firm response. Robin LeBeau, Cheyenne River Sioux Councilwoman for District 5, saw them in the parking lot and promptly told them off.

Darla Goodwin wasn’t surprised when she first heard about the Enbridge Northern Gateway Pipeline.

“We have ancient pictorials and scrolls that speak of a time when the women rise up,” she said. “A great snake was supposed to cross the land and poison Turtle Island, and we’re looking at that as the pipeline.”

Goodwin, an organizer for the Idle No More Vancouver and a member of the Cree First Nation, points to a prophecy, made several hundred years ago and passed down through the indigenous peoples of North America, that describes a time when a great snake will travel across the country, poisoning the land, the water and the air. SFU pressured to drop oil company investments

A student group at Simon Fraser University has joined a national campaign that's pushing campuses to divest endowments from tar sands and other fossil fuel companies.

Sustainable SFU, the independent notfor-profit student society, joined the Fossil Free Canada campaign, launched earlier this year by the Canadian Youth Climate Coalition, which aims to encourage universities to pull their investments in fossil fuel corporations within five years.

"Sustainable SFU, as an organization, in January, passed a motion to initiate this campaign and to call on the university to divest from fossil fuels, to immediately freeze all new investments in fossil fuels and then, over the next five years, to end their investment in co-mingled funds," said Mike Soron, executive director of Sustainable SFU.

Soron acknowledged the process of divesting from such funds is a "very difficult thing to do" but suggested the case for divestment is not just environmental, but also economic and that investing or continuing to invest in fossil fuels is "a massive liability."...

Shut Down the Tar Sands Highway! (video)

On July 6, 2013, hundreds of people gathered at the 4th Annual Tar Sands Healing Walk in Fort McMurray Alberta. During the Walk it was announced that a major oil spill occurred on the Athabasca River flowing into the Lake Athabasca in the Indigenous Community of Fort Chipewyan.

Later that evening at the Celebration Feast for the Healing Walk, Gitz Crazyboy of the Athabascan Chipewyan First Nation announced a call for action to stop traffic on Alberta highway 63 on August 24th, 2013.

Highway 63 is the main artery which carries workers to the Tar Sands production sites North of Fort McMurray....

Trial over Spain Prestige oil disaster ends

Hearings in the trial over one of Europe's worst oil spills wrapped up in Spain on Wednesday after eight months of testimony.

The Prestige oil tanker spilled 50,000 tonnes of oil into the sea when it capsized in the Atlantic in 2002, choking the coasts of Spain, Portugal and France with thick black oil.

On the other hand, Switzerland has only two per cent youth unemployment. They have systems in place to address the problem.

I feel almost overwhelming sadness when I view the oppressively gargantuan quantity of retail available. How many shopping malls, how many airport retail outlets, how many online retail opportunities exist? Even in villages, as well as cities in Africa and Asia, I see masses of goods and hopeful salespeople but not much buying. Is shopping the purpose in life?...

25 Years After Exxon Valdez Oil Spill, Company Still Hasn’t Paid For Long-Term Environmental Damages

The long-term plan for rehabilitating damaged resources has yet to be implemented a full quarter century after the Exxon Valdez oil tanker ran aground in Prince William Sound, Alaska, spewing more than 11 million gallons of crude oil into the surrounding ecosystem.

According to documents released today by Public Employees for Environmental Responsibility, the U.S. Justice Department and State of Alaska say they are still waiting for long overdue scientific studies before collecting a final $92 million claim to implement the recovery plan for unanticipated harm to fish, wildlife and habitat.

Cleaning up the Exxon Valdez disaster took four summers and cost approximately $2 billion, according to the Exxon Valdez Oil Spill Trustee Council. In 1991, Exxon reached a civil settlement with the U.S. government and the state of Alaska in which it agreed to pay $900 million in payments, a $25 million criminal fine and $100 million in restitution....

Couple denied mortgage because of gas drilling (with video)

WASHINGTON COUNTY, Pa. —Brian and Amy Smith seem to be the first example in western Pennsylvania of a homeowner being denied a mortgage because of gas drilling on a next-door neighbor's property.

The drilling goes on day and night at a new Marcellus Shale well in Daisytown, Washington County, and Brian Smith told Channel 4 Action News investigator Jim Parsons that he has no complaints -- except one.

"As far as drilling and the noise and the lights in the window? No," he said. "But when it affected the value of my home? Absolutely."

The Smiths live across the street from the new gas well. They applied for a new mortgage on their $230,000 home and hobby farm, and Quicken Loans congratulated them on their conditional approval.

"They said all the paperwork will be done by the end of the week and we'll be able to close," Brian Smith said. "Somewhere in there, they called us and said, 'Your loan got denied.' "

In an email, Quicken Loans told the Smiths, "Unfortunately, we are unable to move forward with this loan. It is located across the street from a gas drilling site." Two other national lenders also turned down Brian Smith's application....

FBI Investigating Anti-Tar Sands Activists in Seattle, WA

Continuing its longstanding tradition of disrupting political dissent in the United States, the FBI is reported to have visited multiple climate activists in the Seattle area who have participated in anti-tar sands protests this year.

In April of this year, activists staged a protest at the Canadian consulate, to “expose the collusion between the tar sands industry and the Canadian government.”

Six activists have released a statement to The Stranger confirming that they were approached by FBI agents—two of whom have been identified as special agent Matthew Acker and special agent Kera O’Reilly—whom the activists say asked about opposition to tar sands development and brought photographs, hoping the activists would assist the agency in positively identifying others in their community.

This type of repression is no unusual event, considering the FBI routinely prioritizes environmental and animal rights activists as “terrorists,” to be disrupted, discredited or otherwise “neutralized” in the struggle for liberation. It’s important to recognize that this policy of combating dissent has historically culminated in the widespread disruption of  black, feminist, anti-war and American Indian groups, campaigning non-violently for justice in their respective communities, with the agency deploying tactics including the monitoring of phone calls, arbitrary arrest and detention, and even assassination (as observed in the murders of Fred Hampton and Mark Clark).

State (and corporate) repression must be effectively resisted under any circumstance. Our movement for the defense of the earth has met unprecedented disruption in recent years, and it’s vital for our communities to refuse to give safe haven to the FBI or any other law enforcement body endeavoring to destroy all that our movement has built.

Unist'ot'en Camp

Two pipeline workers were just confronted beside their "Canadian Helicopter" chopper about 1/2 km from the Unist'ot'en Camp cabin beside the recent Action Camp site. The ID # for the copper was "C-GNZA". They were aggressively told to "F-OFF and don't EFFIN come back!" They were told that they were behind a Wet'suwet'en blockade which is stopping ALL PIPELINES. They were also told that if they were caught here again things would escalate very rapidly. It was explained to them that we do not want things to escalate but if we found them here again, we will adjust our level of commitment to make sure that they don't return. They claimed that they had no idea that pipeline work is not allowed here and were immediately told that their words were bullshit because the company workers were confronted twice in the past 2 years and told not to trespass. The workers along with their pilot assured that they would leave peacefully and not come back. They disappeared leaving West towards Kitimaat. The closest Canadian Helicopter base besides Smithers is the Terrace base. Thanks to the treeplanters of the company Windfirm for alerting us a couple of days ago regarding the helicopter presence in the blockaded territory. We will keep everyone updated as the story develops.

This morning Michigan Coalition Against Tar Sands (MI-CATS) is taking direct action near Stockbridge to halt construction of the Tar Sands pipeline 6B expansion project of Canadian corporation Enbridge. Over 40 Michiganders have come to oppose the infamous corporation’s flagrant expansion of the very same pipeline that spilled out into the Kalamazoo River only three years ago. Enbridge claims they have restored the river after a spill is no excuse to expand the pipeline, expanding the pipeline increases the risk for everyone.

Residents are currently halting Enbridge’s construction plans by putting their bodies on the line in an act of non violent civil disobedience against Enbridge’s plans. At least 6 people have been arrested so far as police attempt to shut down the protest. 4 people are currently locked down to construction equipment and refusing to move. Police have arrested their medical support team and threaten to arrest anyone who tries to approach them.

This Community Has Spoken: Thou Shalt Not frack

I often ask myself: how much longer can the rogue forces of the fossil fuel industry continue wrecking our planet with impunity? Today I was reminded of our movement’s recurring answer to that question: not for long, if we can help it.

In the early hours of the morning, anti-fracking activists and community members in Balcombe, Sussex, UK, successfully halted the first day of explorations for a new shale gas development by famed (infamous, rather) fracking company Cuadrilla. Over 250 people united in a powerful, peaceful, joyful blockade --  that eventually convinced the trucks containing the initial fracking equipment to abandon the site.....

All night Anti-shale gas truck seizure, road block, ends peacefully despite RCMP negotiation failure. (with audio)

ELSIPOGTOG, NEW BRUNSWICK - Last night, July 27th, about 35 anti-shale gas activists blockaded a 20 ton truck, subcontracted to SWN Resources Canada, for over 8 hours. The truck, filled with helicopter bags - each containing dozens of geophones - was attempting to exit southward along Irving Road, a back road west of highway 126 in New Brunswick. The truck, as well as eight other equipment trucks subcontracted to SWN, were conducting seismic testing in the hopes of finding shale gas deposits along a 35.9 kilometer north-south line known as 'Line 5'. All the equipment and workers were halted until about 3:30am Atlantic Time.

First Nation group furious at Province's move to cut trees down for Enbridge pipeline path

Geraldine Thomas-Flurer, a spokesperson for the Yinka Dene Alliance, vowed today to fight the BC government's moves toward granting Enbridge temporary land use permits to cut trees to gather data for the Northern Gateway pipeline, even before the pipeline has been approved.

Thomas-Flurer of the Saik'uz First Nation decried the absence of what she called "proper consultation" by the Province. 

“There's no way that the Yinka Dene Alliance is going to allow this to happen...we've put up signage on our territories and we're going to be practicing our Aboriginal rights, which we've practiced for a millennium. We're going to stop the people who are on the land who think they can just go out and act on temporary permits."

"We don't want the Province to approve any permits or do anything to advance the proposed Northern Gateway pipeline," she added.  "The Yinka Dene Alliance has said that we are going to be the wall that Enbridge has to go through, and we are adamant about that.".....

[I]For the last three months, 7,300 barrels of bitumen have uncontrollably bubbled to the surface from deep underground and seeped into muskeg and water on four sites at the company's operations, creating an ecological mess, killing wildlife and damaging the reputation of CNRL in particular and the oilsands industry in general.

The company has cut down trees, hauled away tonnes of oily muskeg and put containment booms on a contaminated lake. But the bitumen keeps coming, seeping out of the ground through long, narrow fissures. Not only has CNRL been unable to stop it, the company doesn't know for sure why it keeps coming.The Pembina Institute based in Calgary disturbingly describes the leak as an "uncontrolled blowout in an oil reservoir deep underground."

“I want to support Indigenous rights and sovereignty everywhere, especially those who are opposing extractive industries,” Nitchman told the VMC while on a night-time security shift at the blockade site. At home, she is involved with anti-coal mining campaigns. “Some of the pipelines [here] are for the same industry, and it's the land and water being destroyed in both places for profit, and destroying what little is left that people are able to live on in a sustainable way.”....
