Vic Toews appointed by Manitoba court by the Tories.

More pateonage in favour of someone so clearly unqualified for the job. It just continues with the Tories.

Shame. Was the appointment federal or provincial?

Unionist

Court of Queen's Bench, so it must be federal.

Michael Moriarity

Yes, all superior court appointments are federal. However, much as I despise Toews' right-wing opinions, I see no real reason to think that he will be less honest and competent as a Judge than most other lawyers would be.

Its patronage and if you read some of the things Toews and said over the years he barely qualified to be a human being nevermind a judge. Do you honestly think someone like Vic would give someone a fair trail?

Michael Moriarity

I was a lawyer for a few years back in the 1970s, and every judge I ever appeared before was a political appointment. They were all patronage, mostly Liberal, because Liberals had been in power forever, with the exception of the Diefenbaker years. I was unhappy with many of the conclusions reached by judges in my cases, but it never appeared to me that the politics of the judge before appointment was the reason for my unhappiness. Liberals were just as likely as Conservatives to be, in my opinion, wrong headed in their judgments. They all mostly understood that politics and judging are different functions, and require different methods. Toews may indeed turn out to be an outrageously biased judge, but I can't decide that he will until I see some examples of his judicial behaviour.

I'm sure you'll get an opportunity to see Vic and his lack of principles in action.

Oh Lol!!!!! PERFECT!!!!!!!!!!!!!!!!

The problem with this appointment is the appearance and message it sends, not Toews' qualifications (which are perfectly routine for a QB appt) or concerns re: future bias.

I just don't think it's a good idea to send Cab ministers to the superior courts.

One take:

Also, open speculation that Harper could appoint him as Marshall Rothstein's replacement at the SCC (I was joking about this yesterday, tho I still think it a long shot).

Don't be so quick to dismiss the idea... here's a substantive article in today's G+M exploring this very prospect (great set of readers comments follow):

Toews now a possible candidate for Supreme Court
