Duterte forces Canada to return its garbage from the Philippines!

Philippines' Duterte threatens 'war' if Canada doesn't take trash back

 

More than six years ago, Chronic Inc., a Canadian plastics exporter, dumped more than 100 shipping containers of garbage disguised as plastics for recycling into the Philippines. The containers arrived in Manila in 2013 and 2014.

The trash consisted of used adult diapers, newspapers, plastic bottles and bags. Some experts have said the garbage violates international law.

Last week, Anthony Ho, a lawyer for the Pacific Centre for Environmental Law and Litigation, said the shipments violate multiple parts of the Basel Convention, a 30-year-old treaty that prevents countries from shipping hazardous waste to the developing world without their consent.

This is a Canadian national disgrace. Time for action Canada. What’s The big deal? Go over to the Philippines, pack up the containers, ship them back to the company that sent them there, and send them the bill.  It’s not rocket science.

Canadian politicians never act unless under extreme duress. The rule of thumb when attempting to compel attention is more stick less carrot. Unfortunately, Canadian apathy is also legendary and enabling of lazy politicians more responsive to lobbies than constituents.

I am not sure that it matters which federal government this was done under if it was a private contractor. The present government has taken too long to simply say it will bring it back or accept whatever other options the Philippine government prefers.

Apart from that, if this does not presently merit a jail sentence for the individuals who did this, then a bill has to come before parliament to make sure that never happens again.

So is the company that is responsible for this going to get seriously reprimanded? It was their mistake and gross negligence that led to this. Also, it's becoming increasingly obvious that there are some serious down side to this globalized economy.

Oh, I’m sure the company is probably long gone, the affluent principles protected from damages by their corporate lawyers and this is a very good example why there needs to be caps on any one profession in Parliament. What percentage are lawyers anyways? whatever the percentage is it’s way, way too high!!!

I would like to see a political party running on no lawyers allowed in our party. I’m sure they would do quite well and get lots of support from Canadians. Obviously this is not directed at the lawyers who post here as there are always good exceptions

Leaving aside the probable Charter issues of any party banning an occupation, seeking to form a government on a platform of "no experience allowed" is how you get the Trump administration. I'm all in favour of a diversity of careers in Parliament, but when you're making laws, it does help to have a few lawyers on board.

Would there really be a Charter issue there? The NDP bans members from joining other political parties, even though, if such a restriction were put in place in other contexts(eg. governments saying if you want to apply for welfare, you can't be a member of certain parties), it would definitely be considered a Charter violation.

We should have it all shipped to Edmonton.  100 shipping containers full of garbage and dirty diapers would probably be an improvement over the UCP policy guide for their next 4 years of governance.

I think there's a self-evident reason for that -- you can't serve two masters.

But "no lawyers" is based on nothing but a dislike and distrust of lawyers.

What if a party decided to accept only white members or only christian members? Would that be a charter issue?

Its hard to say whether it is a Charter issue or a Human Rights issue. If it engages the Charter it would have to be tied to a political party's electoral role.  Otherwise if you are denied access to a club or organization it is a human rights complaint because the Charter is our protection against government action and our human rights laws protect us against discrimination by other people and businesses.

Canada has not done the right thing yet. But it looks promising.

“Our nation’s persistence to get the garbage returned to the ‘state of export’ has raised national as well as global awareness about the responsibility of waste exporting countries to respect the rights of people in developing countries and for them to live up to their obligations as parties to the Basel Convention on the control of transboundary movements of hazardous wastes,” she added.
