Settler governments are breaking international law, not Wet’suwet’en hereditary chiefs, say 200 lawyers, legal scholars​

As lawyers and legal academics living and working on this part of Turtle Island now called Canada, we write to demand an end to the ongoing violations of Indigenous nations’ internationally recognized right to free, prior, and informed consent — for example, with the Trans Mountain and Coastal GasLink pipelines routed through unceded Indigenous lands, including Wet’suwet’en lands.

Canadian law and legal institutions — from legislation like The Indian Act to court decisions legitimizing treaty violations with racist stereotypes — have long served as instruments of settler colonialism. And they continue to do so with the legal authorization of the violent dispossession, suppression, and criminalization of Indigenous land and water protectors.

“Think about everything that First Nations people have survived in this country: the taking of our land, the taking of our children, residential schools, the current criminal justice system,” as the late Mohawk legal scholar Patricia Monture-Angus wrote. “How was all of this delivered? The answer is simple: through the law.”

This pattern is perpetuated with the repeated issuance of injunctions — enforced with violence and threat of lethal force by the RCMP — against the Wet’suwet’en working against the Coastal GasLink project, authorized without the consent of the hereditary chiefs vested with jurisdiction over the decision.

The right of free, prior, and informed consent enshrined in the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) logically flows from the recognition that Indigenous governmental, legal, and political orders have existed on this land from time immemorial, long predating the arrival of European settlers.

 Wet’suwet’en: Why Are Indigenous Rights Being Defined By An Energy Corporation?

AN UNSIGNED AGREEMENT between a Wet’suwet’en First Nation and Coastal GasLink along with financial documents obtained by Yellowhead Institute provide reinforcement to Yellowhead’s assessment of the ways these private contracts can dramatically undermine First Nation rights and jurisdiction.

The Impact and Benefit Agreement (IBA) and other documents were drafted in 2016, two years before the first payments were made to the First Nation. Because official agreements are not available to the public due to confidentiality clauses, these documents provide a valuable record of Coastal GasLink’s negotiating objectives.

In light of present RCMP raids, these documents provide important insights that support an emerging analysis around how resource extraction companies work with provinces to limit the scope of the Aboriginal and treaty rights.

The document also introduces the possibility of future negotiations with the band on the pipeline’s conversion to crude oil.

Operating on unceded lands
The pipeline, a natural gas project by Coastal GasLink owned by TC Energy, has been approved by the B.C. government, but it is being opposed by Wet’suwet’en Nation hereditary leadership in the region.

It has been criticized by Amnesty InternationalB.C.’s Human Rights Commission and the UN Committee for the Elimination of Racial Discrimination who say all First Nations affected by the pipeline should give free, prior and informed consent before it can proceed.

Provincial and federal governments, industry and the First Nations LNG Alliance have responded to criticism about the contentious project by citing the consent of elected band councils along the route. Coastal GasLink has signed agreements with 20 First Nations, including with each band council in the Wet’suwet’en Nation.

Irrevocable consent

According to the IBA, Coastal GasLink aims to secure “irrevocable consent” for the project from the First Nation.

The First Nation must also act to dissuade band members from engaging in any internal dissent within the First Nation against the project. The unsigned agreement reads:

  • “[The First Nation] will not take, and will take all reasonable actions to persuade [First Nation] members to not take, any action, legal or otherwise, including any media or social media campaign, that may impede, hinder, frustrate, delay, stop or interfere with the Project’s contractors, any Authorizations or any Approval Processes.”

Experts on IBAs have been warning for years that serious issues can arise when commercial law is used to interpret Aboriginal constitutional rights. With these agreements, we now see how. The draft agreement states:

  • “[this is the] full and final satisfaction of any present or future claim by [the First Nation]… against Coastal Gaslink… for any infringement by the Project of [the First Nation’s] Section 35(1) Rights.”

The extent of constitutional Aboriginal rights is being defined here by a private energy corporation, specifically limiting the exercise of Aboriginal rights. A separate provision affirms that the band can take legal action against British Columbia.

Future protection is granted to Coastal GasLink in the case that Aboriginal rights are expanded to the nation through legal or policy means. The draft agreement states:

  • “If [the First Nation] obtains any interest in land including Aboriginal title or ownership or jurisdiction over lands used by the Project… [the First Nation] affirms the Authorizations … will continue” and that these changes will not affect the Agreement.

Dayna Nadine Scott, a law professor at York University, has interviewed lawyers with experience drafting IBAs for a research project, due out in the spring. She says this language is highly problematic and is often referred to as “gag orders,” preventing communities from raising concerns when new issues come to light.

Therefore, the unsigned agreement restricts the band from challenging any of the company’s legal rights of development, even in the case of changes to the First Nation’s legal rights, as recognised by courts or governments.....

Subsidizing dispossession
LNG Canada is already subsidized by the province of B.C. for $5.35 billion. A further $1 billion in estimated subsidies will be provided by the federal government in exemptions from tariffs on steel imports.

The provincial funding arrangement puts B.C. Premier John Horgan in a conflict of interest with Wet’suwet’en hereditary governments opposing the project.

Horgan has expressed concern about First Nations experiencing “systemic poverty” and characterized the Coastal Gas Link investment into First Nations as “a pathway to prosperity,” according to recent statements in the press.

But a substantial amount of financial support to First Nations are derived from public coffers. Rather than alleviate “systemic poverty” in communities directly, the B.C. government is channelling these dollars through energy companies. Therefore, making First Nation funding contingent upon support for pipeline deals.

These numbers confirm amounts committed in a Natural Gas Benefits Agreement signed between the parties.

Raid
As the RCMP descend on Wet’suwet’en territory it is worthwhile to reflect on how social license is achieved by industry to access Indigenous territories.

A hand-in-glove system, the B.C. government has supported the current raids through financial incentives that have forced communities apart.

With upwards of $7 billion on the line in government subsidies, the interests of Coastal GasLink’s viability appears to have been put far ahead of Wet’suwet’en rights, title and justice.

I was once told by a one time in-house counsel for DIA  that in fact 'First Nation' was a term deliberately concocted  by lawyers in the Dept of Justice Canada as a strategic attempt to evade certain international law definitions etc regarding  'Nations'. In international law there are nations not 'first nations'. Canada also has domestic legislation in which an Indian Act band council is officially recognized and defined as 'the first nation'.  Welcome to Canadian neo-colonialism and usurpation-as-genocide, including nice-sounding pc colonizer poisoned naming which everyone is encouraged to use. A nation is a nation. A 'first nation' not necessarily.

What an outrageous lie the Trudeau/Horgan 'reconciliation-consultation' process is. This area is 'beyond the treaty-frontier', consitutionally outside the jurisdiction of Canada or BC' and under the continuing jurisdiction of its hereditary guardians. Even our own crooked courts can't hide that fact although they try their best.

So, the destruction of the territory continues apace, the RCMP is still on the territory, as is CGL GasLink, and people are going to jail just for trying to get Trudeau/Horgan et al simply to have a meeting, do the right thing and stop the ecocide-as-genocide. Clearly the governments are treating all of us seeking a just and honourable solution to this destructive and illegal development like fools. Clearly the only option remaining is to force the requisite behaviour modification of the Canadian settler-state's  national and provincial leadership, by the application of more pressure. What else is there? Let's do it!

Fatal even. Dear Justin, you had better hope that you can still arrange that nation-to-nation meeting with the Wet'suwet'en. You had better announce an amnesty for all arrested, in the interest of fairness, 'reconciliation', and preserving your ever more precarious political prospects.

If you are serious about turning a new page on Canada's dark colonial past, or even if you were to pretend you are, you need to make nice with those you've offended with your 'hard man' orders and the goon squad arrest tactics that accompanied the performance. Apologize to the Wet'suwet'en, apologize to the Mohawks, apologize to the Gitxsan, and anyone else who deserves one, and announce cancelllation of the Coastal GasLink project and the TransMountain pipeline due to the very real doubts about Canada's own 'title and rights' to impose them in the unceded Indigenous Territories.

Until that is sorted, you can hardly be shoving development projects down the throats of peoples who may turn out to have far superior 'claims' to sovereignty, ownership and jurisdiction over their lands than Canada does. Including ,obviously, a veto on any and all development projects they decide.  I suggest you first make your apologies to the Mohawks and the other aggrieved parties, and then, with Premier Horgan, advise CGL and the RCMP to take a walk, off the territories  while you try and convince the Wet'suwet'en Chiefs to give you another chance at/in  those honourable nation-to-nation meetings the whole country wants to see move forward. If all goes well and peaceful, who knows, those sinking poll numbers could perk up again.

Kenney announces new law clamping down on protestors

On the eve of the Throne Speech and in the wake of Teck’s decision to pull out of its Frontier Mine project, Premier Jason Kenney announced legislation targeting protesters who disrupt vital infrastructure networks.

Kenney blamed Teck’s withdrawal on Sunday in part on the “appearance of anarchy” caused by nationwide protests in support of Wet’suwet’en heridetary chiefs who are opposed to the CoastalGas Link project in northern B.C.

“This decision was taken in large part because of regulatory uncertainty and endless delays created by the national government, as well as the general atmosphere of lawlessness that we have seen take hold of parts of our country and much of our economic infrastructure in the past three weeks,” said Kenney in a speech to caucus, government staff, invitees and media on Monday.

The first bill of the spring session will be the Critical Infrastructure Defense Act, creating new “stiff penalties for anyone who riots on or seeks to impair critical economic infrastructure,” Kenney said.

The government will table the legislationotherwise known as Bill 1, on Tuesday.

Kenney said he had spoken to “major” investors who have cancelled, frozen and suspended major investments in the economy because of the rail blockades.

The Court of Queen’s Bench granted a province-wide, 30-day injunction last week after protesters blocked CN tracks east of Edmonton. Police can be called to serve and enforce that order. In Ontario, police enforced an injunction Monday, dismantling the blockade near Belleville, Ont., that began on Feb. 6 and halted freight and passenger rail service across much of the country.

Kenney targeted “urban green left zealots,” saying they were trying to appropriate protests and condemning Indigenous people to poverty. The Coastal GasLink project, which is supported by all 20 elected First Nation chiefs along the pipeline’s route, is expected to create 2,000 to 2,500 jobs during its four-year construction period....

Inuit Statement of Solidarity with Wet’suwet’en Land Defenders

Inuit from coast to coast to coast have been watching Wet’suwet’en and their resistance movement against Coastal Gaslink’s pipeline that would destroy their traditional territories¹. We have watched as the RCMP violently invaded their unceded lands². We have witnessed the militarized violence enforced and encouraged by all levels of settler governments³.

We are standing together, as Inuit, in unequivocal solidarity with the Wet’suwet’en Land Defenders.

We understand as Indigenous peoples what it is like to be impacted by colonialism. Like our First Nations and Métis cousins, and indeed Indigenous peoples worldwide, we too have been hurt by the violence of resource extraction. From Muskrat Falls⁴ to Clyde River⁵ and all across Inuit Nunangat: we understand deeply the wounds that industry can bring. Whether it’s pipelines, seismic testing, or large-scale hydro dams, the impacts of these dangerous resource projects are far too great⁶. Not only do they threaten our lands and waters, they threaten our sovereignty⁷. Wet’suwet’en is currently facing violent occupation⁸ from the RCMP⁹, whose long-standing¹⁰ anti-Indigenous¹¹ history¹² is well documented¹³ - including atrocities perpetrated against Inuit¹⁴ (both historically¹⁵ and in more recent years¹⁶).

This is why we are standing with the people of Wet’suwet’en: because we’ve been there too.

We are calling on Inuit governments and organizations across Inuit Nunangat and beyond to lend their voices in the growing solidarity movement. So far we have seen statements of support from Nunavut Tunngavik¹⁷, but we call on all other Inuit governments and organizations to join us in standing with Wet’suwet’en.

As Inuit, we are declaring our support for the land defenders of Wet’suwet’en, and all of the Indigenous peoples rising up from coast to coast to coast in solidarity. We assert and affirm our support, now and in future struggles. Solidarity between different Indigenous peoples is vital in this climate of growing anti-Indigenous animosity, racism, and hate. We call on the provincial and federal governments of Canada to meet with the Hereditary Chiefs in a true nation-to-nation fashion. We call on Coastal Gaslink to cease all work and withdraw from Wet’suwet’en Yintah. We condemn the violence, the arrests, the exclusion zones, and the broad actions of the RCMP and call on the RCMP to withdraw from Wet’suwet’en Yintah. And finally, we call upon our Inuit governments and organizations to issue their own statements of support for the land defenders of Wet’suwet’en, the Hereditary Chiefs, the strong Indigenous youth, and all others standing in solidarity.

Good article that will go completely ignored. Us settlers only suppport First Nations who oppose gas and oil lines, we don't care for the views and opinions of First Nations who are pro pipeline. Because we know better than them.

Globe and Mail profiles Gary Naziel, a Laksilyu wing chief, and neglects to mention that he's currently subcontracted by CGL & has worked for CGL for years. Beyond undisclosed conflicts, this should have been fact checked. Feasts opposing pipelines have been held since 2011.

..nobody said it was a crime. that's you trying to paint those opposed in a bad light. that you ignore the democracy going on in favour of looking for division points to your conservative outlook. which is just not relevant to the reality of what is going on. 

 

 

I find it ironic and very indicative that First Nations who support the pipelines (and the stability, security and independence it gives them) are all but being ignored by us settlers who know better.

Ignoring democracy? Hereditary chiefs aren't a democracy or even representitive democracy. Not nessairily a bad thing, but not democractic.

 

 

That said please shut down Toronto and Vancouver. More protests!

(I'm still not sure what threat to our watersystem natural gas presents)

Yes the message is subtle but I agree with it. Clearly a majority of Canadian voters don't give a fuck about anyone's rights except their own and if those damn protestors are not stopped they will vote for a party that will take off the velvet glove and use the full iron fist.

..hereditary chiefs govern with the will of the people. unlike the elected indian act bands. you just have to understand the processes at work to get it.

I had not really thought much about the terminology but of course you are correct: first implies more than one -- that there is a second or more that have greater currency for today. Without much thinking the term attacks the legitimacy while pretending to be beneficial (who does not like being first). It is artful. Thanks for this insight.

Canada's government does a piss poor job of hiding its true nature if you just look at the language. A First Nation's person is a Canadian citizen who has a registry number under the Indian Act. A non status Indian is merely a visible minority citizen at the back of the rights bus with the rest of the visible minorities. Canadians just don't recognize our historic consistency as a race based society. But we call it a democracy.

Protesters, police remain at B.C. legislature for 2nd day of Wet'suwet'en demonstration

Several dozen protesters slept overnight on the steps of the B.C. legislature as their demonstration of support for Wet'suwet'en hereditary chiefs opposed to construction of a pipeline in northern B.C. continued.

As dawn broke over the legislature grounds Tuesday, demonstrators rustled in their tents while police looked on. Other demonstrators slept out in sleeping bags next to pop-up tents and tables of food.

Blockade on Neskonlith rail tracks is back

It didn’t take long for a rail blockade to be re-established on the CP rail tracks near Chase.

After a blockade was set up, and then removed, last Thursday (Feb. 20), it appears the blockade was set up again Monday night. Pictures and videos posted on social media show protesters gathered around a fire next to the tracks. It is across the highway from the Neskonlith Band Hall.....

There can’t possibly be a modern image that more viscerally drives a dagger through the heart of reconciliation than the sight of five heavily armed bullet-proof-vested Ontario Provincial Police officers wrestling a Mohawk demonstrator to the ground.

There can’t possibly be words more ironic than Prime Minister Justin Trudeau’s on Friday saying Canadians are “running out of patience.” That he said this just days after telling opposition leader Andrew Scheer “patience may be in short supply and that makes it more valuable than ever” highlights the insincerity of his political statements. That he thinks he can lecture Indigenous folks on patience highlights colonial hubris.
