Trump and supporters' voter suppression

Black North Carolina voters heading to the polls were pepper sprayed by a racist police department yesterday. Sounds like the 1960s again. 

On Saturday, Alamance County sheriff’s deputies and city police pepper-sprayed a crowd of about 200 people who were peacefully marching to the polls in Graham, North Carolina, without warning and on slim reasoning. Graham police claimed that protesters didn’t have the adequate permits to close off the road, while the Alamance County Sheriff’s Office said that the march was shut down out of “concerns for the safety of all.”

If it is at all difficult to understand how a police department could act so heinously—particularly when children and elderly community members are present within the crowd—then it’s important for one to grasp the context that the law enforcement operates within.

This is the second time since 2016 that Alamance County has made national news for its treatment of voters. In 2017, 12 residents, most of whom were Black and on parole or probation for felony charges, were charged for illegally voting in the 2016 election. If someone is convicted of a felony in North Carolina, they lose their right to vote for the entirety of their incarceration and until any parole or probation has concluded—another key method of voter suppression in the state. ...

Alamance County Sheriff Terry Johnson, who has held the position for almost 18 years, has a record defined by racism and intimidation. As the 2004 general election approached, Johnson announced that he would send deputies to the homes of all new registrants with a Hispanic-sounding name to investigate whether they were citizens. He claimed that undocumented people were registering to vote at local Division of Motor Vehicles offices with falsified documents. (The Justice Department sent election monitors to Alamance in 2004, 2008, and 2012.)

Johnson has a history of making incredibly racist statements about immigrants—including egregious, nonsensical claims that it’s socially acceptable to sexually assault underage girls in Mexico. The sheriff has been vehement about incarcerating “criminal immigrants,” or “taco eaters,” who are coming into the country to “victimize our children, our citizens, with drugs, murders, rapes, robberies, you name it.” In early 2019, he told the Alamance County Board of Commissioners that undocumented “criminals” were “raping our citizens in many, many ways.”

Beyond his rhetoric, Johnson has used his office to wreak havoc on immigrant communities in Alamance. The sheriff’s office was sued by the Justice Department for an alleged pattern of abusive enforcement against Latinos, including charging Latino drivers with traffic violations at least six times as often as non-Latino drivers. (A district court dismissed the suit, and it was then settled in lieu of an appeal, with the sheriff’s office agreeing to implement a “bias-free policing plan” and other reforms.) Johnson has also advocated for higher policing budgets in order to crack down on immigration, and used money from the $3.6 million the county received from housing Immigration and Customs Enforcement detainees in 2019 to give out bonuses to his staff.

This summer, as citizens were demanding the removal of a Confederate statue in Graham, the sheriff’s office announced that the city’s police department would not be granting permits to protesters. When an activist asked Johnson why he and his deputies were “breaking the law” by forgoing North Carolina’s mask mandate, he replied: “Ma’am, you’re breaking the law. We know you’re a member of antifa.

Trump tweeted his support of the Trump caravan of supporters who almost drove Kamala Harris's bus off the road in Texas. 

President Trump is celebrating a caravan of supporters who followed a Biden-Harris campaign bus in Central Texas.

In a Saturday night tweet, the president retweeted a video showing his supporters surrounding the bus, set to Tech N9ne's "Red Kingdom." "I LOVE TEXAS!" Trump said.

The tweet came after a separate video surfaced showing vehicles with Trump 2020 flags boxing in the blue campaign bus as it traveled Interstate 35 from San Antonio to Austin. In a statement, the Biden campaign said the cars slowed in front of it in an attempt to "stop the bus in the middle of the highway," The Washington Post reported

The Friday incident rattled the Biden campaign, which canceled at least one event in the state following the episode. Campaign staff called 911, according to the statement, and was given help by law enforcement reaching its destination.

Neither Joe Biden, who had been campaigning in the Midwest, nor his running mate Kamala Harris, campaigning elsewhere in Texas, were on the bus at the time. ...

Trump discussed the caravan at a Michigan campaign event on Sunday. 

"Did you see the way our people, they were, ya know, protecting this bus ... because they're nice," he said. "They had hundreds of cars. Trump! Trump! Trump and the American flag."

Trump favorably contrasted his supporters with Biden supporters, who he said lack spirit and enthusiasm.

"The Trump Train is in hot pursuit," wrote one of the participants of the caravan on Twitter, where they posted several updates of the location of the Biden bus throughout the day. "Just a few of our great patriots out there." 

In another video of the incident posted to social media, a truck in the caravan clips a white car.

"Rather than engage in productive conversation about the drastically different visions that Joe Biden and Donald Trump have for our country, Trump supporters in Texas today instead decided to put our staff, surrogates, supporters, and others in harm's way," the Biden campaign's Texas communications director, Tariq Thowfeek, said in a statement, The Post reported.

Biden addressed the incident and others Sunday in Philadelphia, telling reporters: "We've never had anything like this — at least we've never had a president who thinks it's a good thing."

The Friday incident comes amid a particularly heated contest in Texas, where polls show Biden in striking distance of winning a state that no Democratic nominee has won since 1976. ...

Katie Naranjo, chair of the Travis County Democratic Party, said the caravan was a clear attempt by Trump's base to intimidate Biden supporters. "They ran into a person's car, yelling curse words and threats," Naranjo said. "Don't let bullies win, vote."

"We just canceled a joint event in Pflugerville" with the Biden campaign "due to security reasons," Texas House member and former Austin city councilwoman Sheryl Cole said on Twitter. "Unfortunately, Pro-Trump Protestors have escalated well beyond safe limits."

Trump lost his Houston voter suppression lawsuit today but of course it will be appealed.

 A federal judge on Monday rejected another last-ditch Republican effort to invalidate nearly 127,000 votes in Houston because the ballots were cast at drive-thru polling centers established during the pandemic. 

The lawsuit was brought by conservative Texas activists who have railed against expanded voting access in Harris County, where a record 1.4 million early votes have already been cast. The county is the nation’s third-most populous and a crucial battleground in Texas, where President Donald Trump and Republicans are bracing for the closest election in decades on Tuesday. ...

U.S. District Judge Andrew Hanen’s decision to hear arguments on the brink of Election Day drew concern from voting rights activists, and came after the Texas Supreme Court rejected a nearly identical challenge over the weekend. 

“We cannot allow participation to be limited simply because there are those who choose to think that they have the ability and the authority to decide who votes,” Democratic Rep. Al Green, of Houston, said outside the courthouse after the ruling. “It’s the Constitution that determines who votes.”

Hanen said those who oppose drive-thru centers — who were represented by former Harris County GOP Chairman Jared Woodfill— had no standing to bring a lawsuit. He added that people had already voted and that conservative activists had months to bring a challenge sooner. ...

But Hanen still expressed doubts about whether Texas law allowed anyone to vote from their car, even during a pandemic. 

“I would not vote in a drive-thru just out of my concern as to whether that’s legal or not,” Hanen said.

Woodfill filed a notice of appeal Monday evening to the 5th U.S. Circuit Court of Appeals. After Hanen’s ruling, he accused Harris County officials of using their office to help Democrats win Tuesday. 

“If Harris County goes against Trump in large enough numbers, then we could lose Texas. And if Trump loses Texas then we lose the national election,” Woodfill said after the ruling. “As far as I’m concerned this is ground zero.” 

Another 20,000 or more voters were expected to use drive-thru polling locations Tuesday, said Harris County Clerk Chris Hollins, the county’s top elections official. Several voters who already used the drive-thru centers rushed to join mounting opposition to the lawsuit, including a Houston attorney whose wife was 35 weeks pregnant when she cast her ballot. She gave birth to twins Friday.

“My vote counts,” David Hobbs said. “My wife’s vote counts.”

Trump won Texas by nine points in 2016 but polls have shown Democrat Joe Biden still within reach in America’s biggest red state. Democrats also need to flip only nine seats to reclaim a majority in the Texas House for the first time in 20 years, and have aggressively targeted several races in Harris County. 

Woodfill has been a part of a battery of court challenges over moves to expand voting options during the COVID-19 pandemic. The challenges have not involved Trump’s campaign.

Voter suppression was part of the Democratic party's strategy in the South until it became part of Nixon's Southern Strategy in 1968. Pual Weyrich made the Republican strategy clear in 1980 with his famous: "I don't want everyone to vote. Elections have never been won by a majority of people in our country and they are not now. The chances of our winning goes up as the voting population goes down". Trump justs says the silent part out loud in the Weyrich manner, that most Republicans and, before 1968 most southern Democrats, won't say although they acted upon it.

Ben Ginsberg, who was national campaign lawyer for Bush-Cheney in 2000-2004 and was involved as lawyer in the Flordia recount and in the Swift Boats affair that smeared John Kerry with lies about his Vietnam service in 2004, well knows the Republican game. He now says about Trump:

The Trump campaign and Republican entities engaged in more than 40 voting and ballot court cases around the country this year. In exactly none — zero — are they trying to make it easier for citizens to vote. In many, they are seeking to erect barriers.

All of the suits include the mythical fraud claim. Many are efforts to disqualify absentee ballots, which have surged in the pandemic. The grounds range from supposedly inadequate signature matches to burdensome witness requirements. Others concern excluding absentee ballots postmarked on Election Day but received later, as permitted under state deadlines. Voter-convenience devices such as drop boxes and curbside voting have been attacked....

"...This attempted disenfranchisement of voters cannot be justified by the unproven Republican dogma about widespread fraud. Challenging voters at the polls or disputing the legitimacy of mail-in ballots isn't about fraud. Rather than producing conservative policies that appeal to suburban women, young voters or racial minorities, Republicans are trying to exclude their votes." ...

During the first presidential debate in late September, Trump answered a question about whether he would urge calm if the election outcome wasn't immediately known this way:

"I'm urging my supporters to go into the polls and watch very carefully because that's what has to happen. I am urging them to do it. As you know, today there was a big problem. In Philadelphia, they went into watch, they were called poll watchers, a very safe very nice thing. They were thrown out. They weren't allowed to watch. You know why? Because bad things happen in Philadelphia. Bad things. And I am urging, I am urging my people- I hope it's gonna be a fair election. If it's a fair election, I am 100% on board. But if I see tens of thousands of ballots being manipulated. I can't go along with that."

After the video appeared on social media, the president tweeted out his support for his supporters who surrounded the bus, displaying an edited video that omitted their more violent acts. “I LOVE TEXAS!” Trump said on Twitter Saturday....

Neither Harris nor Biden were on board the bus during the apparent attack, but Democratic candidates running in local races were riding on it, including former state lawmaker Wendy Davis, who is running for a U.S. House seat in Texas. After the dangerous provocation on the highway unfolded, Davis and others on the bus canceled their planned campaign event due to safety concerns.
