  1. 1  its impeachment against him for high crimes and mis-

  2. 2  demeanors.

  3. 3  ARTICLE I: INCITEMENT OF INSURRECTION

  4. 4  The Constitution provides that the House of Rep-

  5. 5  resentatives ‘‘shall have the sole Power of Impeachment’’

  6. 6  and that the President ‘‘shall be removed from Office on

  7. 7  Impeachment for, and Conviction of, Treason, Bribery, or

  8. 8  other high Crimes and Misdemeanors’’. In his conduct of

  9. 9  the office of President of the United States—and in viola-

  10. 10  tion of his constitutional oath faithfully to execute the of-

  11. 11  fice of President of the United States and, to the best of

  12. 12  his ability, preserve, protect, and defend the Constitution

  13. 13  of the United States, and in violation of his constitutional

  14. 14  duty to take care that the laws be faithfully executed—

  15. 15  Donald John Trump engaged in high Crimes and Mis-

  16. 16  demeanors by willfully inciting violence against the Gov-

  17. 17  ernment of the United States, in that:

  18. 18  On January 6, 2021, pursuant to the Twelfth

  19. 19  Amendment of the United States Constitution, the Vice

  20. 20  President of the United States, the House of Representa-

  21. 21  tives, and the Senate met at the United States Capitol

  22. 22  for a Joint Session of Congress to count the votes of the

  23. 23  Electoral College. Shortly before the Joint Session com-

  24. 24  menced, President Trump addressed a crowd of his polit-

  25. 25  ical supporters nearby. There, he reiterated false claims

  26. 26  that ‘‘we won this election, and we won it by a landslide’’.

  1. 1  He also willfully made statements that encouraged—and

  2. 2  foreseeably resulted in—imminent lawless action at the

  3. 3  Capitol. Incited by President Trump, a mob unlawfully

  4. 4  breached the Capitol, injured law enforcement personnel,

  5. 5  menaced Members of Congress and the Vice President,

  6. 6  interfered with the Joint Session’s solemn constitutional

  7. 7  duty to certify the election results, and engaged in violent,

  8. 8  deadly, destructive, and seditious acts.

  9. 9  President Trump’s conduct on January 6, 2021 was

  10. 10  consistent with his prior efforts to subvert and obstruct

  11. 11  the certification of the results of the 2020 presidential

  12. 12  election. Those prior efforts include, but are not limited

  13. 13  to, a phone call on January 2, 2021, in which President

  14. 14  Trump urged Georgia Secretary of State Brad

  15. 15  Raffensperger to ‘‘find’’ enough votes to overturn the

  16. 16  Georgia presidential election results and threatened Mr.

  17. 17  Raffensperger if he failed to do so.

  18. 18  In all of this, President Trump gravely endangered

  19. 19  the security of the United States and its institutions of

  20. 20  government. He threatened the integrity of the democratic

  21. 21  system, interfered with the peaceful transition of power,

  22. 22  and imperiled a coordinate branch of government. He

  23. 23  thereby betrayed his trust as President, to the manifest

  24. 24  injury of the people of the United States.

  1. 1  Wherefore President Trump, by such conduct, has

  2. 2  demonstrated that he will remain a threat to national se-

  3. 3  curity, democracy, and the Constitution if allowed to re-

  4. 4  main in office, and has acted in a manner grossly incom-

  5. 5  patible with self-governance and the rule of law. President

  6. 6  Trump thus warrants impeachment and trial, removal

  7. 7  from office, and disqualification to hold and enjoy any of-

  8. 8  fice of honor, trust, or profit under the United States.

Incitement is difficult to prove as a crime under U.S. law.  You almost have to say, go attack the Capitol.  But incitement in the general sense can form the basis of impeachment as conduct unworthy of continuing to hold high office.

I'm glad they added the part about the phone call to Georgia's Secretary of State

Sen. Sanders: "Some people ask: Why would you impeach and convict a president who has only a few days left in office? The answer: Precedent. It must be made clear that no president, now or in the future, can lead an insurrection against the U.S. government."

Politics is not a simple matter of right and wrong.   It is a matter of priorities. Yes, Trump did wrong, he is a bad guy. But the country is in the grips of a pandemic – over 4000 people died on Thursday – and in December, the country lost 140,000 more jobs. The Democrats have to focus on that not on Trump. . . .

There is a simple political lesson here.  By giving all their attention to halting the pandemic and making sure the economy bounces back, Biden and the Democrats will be doing what the nation needs and wants.  It is also what the Democrats need to do if they want to retain control of the Congress in 2022.  If they allow the budget fight to drag on, and the pandemic and recession to drag on, they could lose control of the Congress in 2022 – recall how narrow the margins are.  In that case,  whatever good they will be able to do can easily be undone by Republican majorities in the House or Senate. And Democrats might lose the White House in 2024. Think again of Obama’s first year and how by not paying sufficient attention to the politics, the Democrats lost the House in 2010.

Sure, people in Washington and Democratic activists around the country want to punish Trump. In that case, censure him.

If Trump were impeached and convicted, it would likely only take a majority vote of the senate to bar him from serving as president again.  Of course that doesn't bar one of his idiot children from running.

I think it's the worst decison they could make and hubris more than anything at this point.

If the US wants to de-escalate the powder keg they're sitting on then step 1 would be worrying about moving forward and appealing to the many republican moderates out there.  A lot of Americans felt Trump was sticking up for them. Just because he's not on Twitter doesn't mean he's not in a position to say or do something very stupid and very dangerous to the 70 million Americans who voted for him, many of whom now have a very antagonistic towards them government coming into power..

He doesn't deserve a back door and a way out, but compare it to the mayhem and stupidity that could happen if even semi-competent people decided to start trouble.

I've seen some pretty wacky calls about going after Trump supporters and from getting them fired to harassing them to throwing them in jail. I don't think would turn out how people are fantasizimg it would.

No one said anything about not appealing to moderates, but Trump and his fascist entourage need to be stopped in their tracks, and made to pay a very heavy price for their criminal behaviour

Paladin1, should Trump ever be held accountable? Many of Trump's rioters are going to go to jail for listening to Trump, so should Trump get off scott free while members of his mob go to jail because they listened to Trump? Do you think it was wrong that Bill Clinton was impeached for an infinitely less grievous transgression?

WATCH: "...The worst thing we can do is prolong this. The page is going to be turned on January 20th. This is a complete waste of taxpayers' money. Did President Trump say we need to continue to protest? No. So he's not a 'clear and present danger' to this country. That's absurd and ridiculous. The man's going to leave office in 11 days.

To sit there and pick up articles of impeachment on Monday is a facade, a farce and a fraud. I'm really praying that Nancy Pelosi doesn't do this, but I think they're looking to milk it for political advantage and political gain. It's not going to happen. There's not even enough time. You're going to get 2/3 of the chambers of the House and Senate to agree to impeach somebody who has a week left? No, of course not..."

It wasn't a landslide but it also wasn't even close as Biden won by 7 million votes. Look how nice it has been since Trump has been quieted by twitter.
