For over five years Trump has said that the only way he could lose an election would be if the election was stolen from him due to fraud by Democrats. He said that he won the popular vote in 2016 but that was taken away from him due to fraud by Democrats. Trump set up a commission to look into election fraud in 2016 but that commission disbanded because it could find no evidence. Trump is now saying that at least 10 million votes were fraudulently cast for Joe Biden but he has no evidence to prove his self-serving claim. How many conspiracists would be required to steal 10 - 20 million votes? And why should we believe a man who has pathologically lied countless times including his saying that Obama was not born in the U.S., that Muslims in New York City cheered on rooftops on 9/11 while watching the Twin Towers fall, and said the Central Park 5 should receive the death penalty even though they were found innocent. As it is, fact-checkers say that Trump lied over 30,000 times during his 4 years in office! That's over 20 lies on average per day for four years!! Trump lies as easily as he breathes air! That's why so many QAnon supporters love him.

Quite aside from the difficulties of proving 'incitement' of an 'insurrection' that never was, The duopoly will necessarily have to contrive their kangaroo shake and bake impeachment trial to carefully exclude the Trump defence team's ability to bring to a global public for the first time  the massive evidence of election fraud. Because both parties know it exists, and is anything but 'baseless', they, like the courts, will contrive to find the technical  grounds to prevent it being heard. Or make Trump 'an offer he can't refuse' to force him to exclude it himself.

As to whether Trump did or did not incite violence before the Capitol riot, I recommend this video, from YouTuber LonerBox, a Scot. He uses Ian Paisley, leader of the Ulster Unionists during the troubles, as an example of how a political leader can clearly inspire violence withoug explicitly urging any specific act of violence. He then shows how the same principle applies to Trump.

Stochastic terrorism[edit]

The first mention of the term "stochastic terrorism" appears to be in a 2002 article written by Gordon Woo entitled "Quantitative Terrorism Risk Assessment" in the Journal of Risk Finance.[30] The term is used to suggest that a quantifiable relationship may exist between seemingly random acts of terror and their intended goal of "perpetuating a reign of fear" via a manipulation of mass media and its capacity for "instant global news communication". For example, careful timing and placement of just a few moderately explosive devices could have the same intended effect as numerous random attacks or the use of more powerful explosives if they were shrewdly devised to elicit the maximum response from media organizations. Thus, it was theorized by Dr Woo that "the absolute number of attacks within a year, i.e. the rhythm of terror, might ultimately be determined as much by publicity goals and the political anniversary calendar as by the size of the terrorist ranks".

A derivation of Dr Woo's stochastic terrorism model was proffered by an anonymous blogger posting on Daily Kos in 2011 to describe public speech that can be expected to incite terrorism without a direct organizational link between the inciter and the perpetrator.[31][32] The term "stochastic" is used in this instance to describe the random, probabilistic nature of its effect: whether or not an attack actually takes place. And, although the actual perpetrator of a planned attack and its timing is not under the control of the stochastic terrorist, their actions nevertheless serve to increase the probability that a terrorist attack will occur.[33] The stochastic terrorist in this context does not direct the actions of any particular individual or members of a group. Rather, the stochastic terrorist gives voice to a specific ideology via mass media with the aim of optimizing its dissemination.[33]

It is by dint of this ideology that the stochastic terrorist is alleged to randomly incite individuals predisposed to acts of violence. And it is because the stochastic terrorist does not target and incite individual perpetrators of terror with their message that the perpetrator may be labeled a lone wolf by law enforcement while the inciter avoids legal culpability.[33][34] The term has mostly been applied to domestic American incidents of violence.[citation needed]

In their 2017 book Age of Lone Wolf Terrorism,[33] criminologist Mark S. Hamm and sociologist Ramón Spaaij discuss stochastic terrorism as a form of "indirect enabling" of terrorists. They write that "stochastic terrorism is the method of international recruitment used by ISIS", and they refer to Anwar al-Awlaki and Alex Jones as stochastic terrorists.[33]:157

Hamm and Spaaij discuss two instances of violence. In the 2010 Oakland freeway shootout, Byron Williams was said to be en route to offices of the American Civil Liberties Union and the Tides Foundation, planning to commit mass murder, "indirectly enabled by the conspiracy theories" of Glenn Beck and Alex Jones. As a left-wing example, they cite the 2012 shooting incident at the headquarters of the Family Research Council.[33]

The stochastic terrorism model is a stochastic process, a random model of those terror attacks intended by the random nature of their timing and targets to excite a generalized fear.[35] Nonetheless, lone wolf terrorists are "indirectly enabled by the conspiracy theories"[33] circulated in the mass media, especially by high status political or religious leaders.

Texas Republican Will Hurd drew upon his six years in Congress and nine years as a clandestine CIA officer in a hard-hitting new op-ed published by The Washington Post.

Hurd, who did not seek re-election in 2020, warned that the 2022 midterms will be consumed by ads highlighting the connections between the GOP and the deadly insurrection by Trump supporters at the U.S. Capitol on January 6th.

"Republicans have lost seven of the last eight national popular votes, and it only took four years for us to lose the House, Senate and the White House. Republicans aren't going to achieve electoral success by being seen as the party that defends QAnon extremists who advocate the murder of the former vice president. Nor will we see success by supporting white supremacists who call a Black police officer the n-word while that police officer puts his life on the line to protect democracy. Every Republican on the ballot in 2022 will face campaign attack ads that affiliate them with the domestic terrorists who charged the U.S. Capitol on Jan. 6," he warned.

Hurd explained how disinformation harms the GOP.

"If the party wants a future, the elected officials, pundits and activists who claim to be its members must stop peddling conspiracy theories and drive out those who continue to do so. Republicans must be honest and do the right thing based on conservative values, not the thing that leads to more clicks, comments or shares on social media," Hurd wrote. "Those of us who were old enough on 9/11 will always remember the image of the second plane slamming into the World Trade Center, just like all of us will remember the images of thousands of people at the Capitol attempting an insurrection on Jan. 6. Both were acts of terrorism conducted by fanatics. If Islamist terrorism was the existential challenge of the early 2000s, then the environment of disinformation, misinformation and lies fueling domestic terrorism is the challenge of our current generation. This 'infodemic' is getting worse, and it is radicalizing elements of our society."

Hurd also gave his party a civics lesson.

"The truth is, President Donald Trump lost big time. Many Republicans on the ballot across the country in 2020 outperformed the president by significant margins. He was an anchor around our necks at the voting booth," he noted. "Furthermore, if you elevate a flag that has someone's name on it to the same level that you elevate your national flag, then you are not a patriot; you are part of a cult. When we put our hands on our hearts, we pledge allegiance to a flag, not an individual. The flag represents a nation founded on a perpetual goal to form a more perfect union, not a commitment to any one person."

They were given a chance to present evidence but, as judge after judge found, they had none.  Changing the the vote ballot deadline was not "clearly unconstitutional."  And it was done in North Carolina.  But guess what, no challenge was brought there. Because Trump won the state.  So this was about Kracken heads trying to overthrow the results of the election.  Not a stand against changing voting procedures in the face of an epidemic.

This is not a trial but a partisan political exercise. Everywhere in the world people call this sort of thing a show trial. Now before our imperial cheerleaders jump down my throat I think Trump should be charged with treason if they can prove he incited a riot, however as a former lawyer I would not consider the procedural checks and balances in a Senate impeachment trial adequate to ensure a fair hearing. The first thing of course is that all the Senators have an inherent partisan conflict of interest and therefore are unsuitable as unbiased jurors. But then again this is the US were you can guess the result of almost every SCOTUS decision based on partisan politics without having to actually understand anything about the jurisprudence behind the legal issues at play.

The full force of the farce is on display for all the world to laugh at. Bring it on America this is one exceptional process you have.

I hope he is convicted...as he should have the first time around. He's a fascist who should never be able to run for office ever again---anywhere. Not even a dog catycher.

Trump,Cruz,Hawley and the rest of the seditionists should be trioed and imprisoned.

Everyone involved in the attempted insurrection should be arrested, tried and convicyted for treeason. They should all be ssent to the gallows.

Capitol police who aided and abetted these ultra right wing maniacs should also be tried.

But will any of this happen? I doubt it. Unless it was antifa (anti fascists ironically) and BLM, there would be blood spilled and stiff prison sentences. The fascists seem to be  becoming mainstream.

The US can never call themselves the home of the free anymore. They can hardly call themselves democratic. They are on the verge of becoming a banana republic.

The US and Canada need to label these assholes like the Proud Boys terrorist groups.Right next to Al Quaeda. Hell. the orange bastard wanted to label BLM a terrorist group!
